The Doping Incident

In 2022, during the U.S. Open, Halep tested positive for the banned substanceย Roxadustat. Her first-round loss to Daria Snigur of Ukraine marked the unfortunate turning point. Roxadustat, approved for use in the European Union to treat anemia caused by chronic kidney failure, stimulates the production of erythropoietin (EPO). EPO has long been associated with doping in endurance sports like cycling and distance running.

The CAS Decision

Simona Halepโ€™s legal team, led by lawyer Howard Jacobs, argued that she had inadvertently consumed a contaminated supplement, leading to the failed test. The CAS panel acknowledged that Halep bore โ€œsome level of fault or negligenceโ€ but deemed her anti-doping violationsย non-intentional. Consequently, her four-year ban was reduced to a mere nine months.

  • Although the CAS Panel found that Ms. Halep did bear some level of fault or negligence for her violations, as she did not exercise sufficient care when using the Keto MCT supplement, it concluded that she bore no significant fault or negligence.

The CAS judges also awarded Halep 20,000 Swiss francs ($22,650) towards her legal fees from the ITIA.
